1. Agreement to Terms
These Terms & Conditions (“Terms”) govern your use of the bayareapaints.com website and any painting or related services provided by Bay Area Paints (“we”, “us”, “our”). By accessing our website, requesting an estimate, or hiring us for a project, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.
2. Our Services
Bay Area Paints is a licensed California painting contractor, CSLB License #1076207, and our license status can be verified with the California Contractors State License Board at cslb.ca.gov. We provide interior and exterior residential and commercial painting services, surface preparation, and related finishing work. The specific scope of work for your project, including surfaces to be painted, products to be used, and timelines, will be described in the written estimate or work order you receive and approve.
3. Estimates, Quotes and Pricing
All estimates are provided in good faith based on the information available at the time of the site visit or consultation. Unless stated otherwise, an estimate is valid for thirty (30) days. Prices may change if the scope of work is altered, if hidden conditions such as water damage, mold, dry rot, or failing substrates are discovered, or if additional coats or preparation are required. Any change in price will be communicated to you and approved before the additional work begins.
4. Scheduling and Access to the Property
Project start dates and completion estimates are approximate and may be affected by weather, material availability, permit requirements, or conditions at the job site. You agree to provide safe and reasonable access to the areas to be painted, along with access to water and electricity where needed. Delays caused by lack of access may result in rescheduling.
5. Payment Terms
Payment terms, including any deposit and progress payments, are set out in your estimate or contract. Final payment is due upon substantial completion of the work unless agreed otherwise in writing. We accept the payment methods listed on your invoice. Late payments may be subject to a reasonable late fee as permitted by California law.
6. Cancellations and Rescheduling
If you need to cancel or reschedule a confirmed project, please contact us as soon as possible. Cancellations made after materials have been purchased or custom colors mixed may be subject to charges for those materials and for labor already performed. Your statutory right to cancel a home solicitation contract within the period required by California law is not affected by this section.
7. Customer Responsibilities
To help us deliver the best result, you agree to remove or protect valuables, fragile items, and window coverings where practical, secure pets, disclose known hazards such as lead-based paint or asbestos, and confirm color selections in writing before work begins. We take care to protect your property, but we cannot accept responsibility for items that were not disclosed or removed.
8. Workmanship and Satisfaction Guarantee
We stand behind our craftsmanship. Any workmanship warranty applicable to your project, including its duration and coverage, will be stated in your written estimate or contract. Warranties do not cover damage caused by structural movement, moisture intrusion, abuse, neglect, normal wear and fading, or work performed by others. Manufacturer warranties on paints and coatings are provided by the manufacturer, not by us.
9. Materials and Color Selection
Color samples, digital renderings, and printed swatches are representations only. Actual applied colors may vary based on lighting, surface texture, sheen, and substrate. Where possible we recommend approving a physical sample on site. If you supply your own materials, we cannot warrant the performance or appearance of those products.
10. Website Use
The content on this website is provided for general information only. You agree not to misuse the site, attempt to gain unauthorized access to it, interfere with its operation, or use any automated system to extract data from it. We may modify, suspend, or discontinue any part of the website at any time.
11. Intellectual Property
All text, graphics, logos, photographs, and other content on this website are owned by Bay Area Paints or used with permission and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent. Photographs of completed projects may be used by us for portfolio and marketing purposes unless you ask us in writing not to do so.
12. Third-Party Links
Our website may contain links to third-party websites or resources. We do not control those sites and are not responsible for their content, products, or privacy practices. Following an external link is at your own risk.
13. Limitation of Liability
To the fullest extent permitted by law, Bay Area Paints will not be liable for indirect, incidental, special, or consequential damages arising out of your use of this website or our services. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for personal injury caused by negligence.
14. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. We encourage you to contact us first so we can try to resolve any concern directly. Any dispute that cannot be resolved informally will be handled in the state or federal courts located in the San Francisco Bay Area, California.
15. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on this page with a new effective date, and it will apply to your use of the website from that date forward.
